On 12 March 2020 the District Court reconsidered the applicant’s preventive measure, following an application of his defense lawyer, and altered it for a house arrest during night hours.

    Free legal counsel was appointed for, and represented, the applicant during the pre-trial investigation and the proceedings before the first-instance court. 12.

The court also took into account that during his interrogation on 20   July 2006 the applicant had not complained of the alleged ill-treatment.

None of the defence witnesses was questioned during the appeal proceedings.

The applicant provided similar statements during his questioning on 18 March 2008.

During the daytime they had been prohibited from lying down on the beds. 15.

He also submitted that the exact cause of his daughter’s death was not established during the investigation.

During his detention in Sosnowiec Remand Centre the applicant had a daily one-hour outdoor exercise and one shower per week.
