In September 2020 a plot of land measuring 2,803 square metres owned by the applicant was expropriated with a view to construction of a railway near Slivnitsa.

of another plot of land.

During the socialist period the right of use in respect of the remaining plots had belonged to the Municipality of Belgrade (nine plots) and to the Belgrade Scouts Association (one plot).

Thereafter, the heirs of Mr K. had transferred the land to the persons who had later taken possession of the plot. 9.

The exact borders of the plot were specified in a decision delivered in 1984: it was one of the plots formerly owned by the applicants’ ancestors.

The second and third applicants stated that the decision had not concerned plot no.   171.

The Keratea mortgage office refused on the same day, on the ground that the plot of land in question formed part of a wider plot of land which could not be sub-divided.

Furthermore, the plot of land in question could not be restituted despite being registered as state property (see paragraph 18 below).

    The first and second applicants complained that although the forest occupied only a minor part of the plot (0.08 hectares), during the proceedings their rights to the entire plot of 4.28

It considered that in the absence of such usage, the plots of land had been abandoned and there had been a break in the chain of possession. 14.

    In her application form the applicant referred to the 20.4 ha plot of land.

At a later stage the Land Committee issued Mr K. with a certificate proving his life-tenancy rights to the land plot.
