MOLDOVA AND THE RUSSIAN FEDERATION   Wednesday 6 June 2001 at 9 a.m.   The applicants   The case concerns an application brought by four Moldovan nationals, Ilie Ilaşcu, who was born in 1952, Alexandru Leşco, born in 1955, Andrei Ivanţoc, born in 1961 and Tudor Petrov-Popa, born in 1963. The first applicant is also a Romanian national.   Summary of the facts   All but the first applicant are currently detained in the “Dniester Moldova Republic” (DMR), a region of Moldova that is known by the name of Transdniestria, which declared itself independent in 1991. The first applicant, Mr Ilie Ilaşcu, was sentenced to death in 1993 by a court of the self-proclaimed republic and an order was made for the confiscation of his assets. He was released on 5 May 2001. The other applicants were sentenced by the same court to terms of imprisonment of between twelve and fifteen years and orders were made for the confiscation of their assets.   Complaints   The applicants complain of a violation of Article 6 (right to a fair hearing) of the European Convention on Human Rights on the ground that they were convicted by a court that had no jurisdiction and that in any event the proceedings in which they were convicted were unfair. They maintain also that their detention was unlawful, in breach of Article 5 (right to liberty and security). The first applicant complains that his death sentence violated Article 2 (right to life). All the applicants also complain of the prison conditions, relying on Articles 3 (prohibition of inhuman or degrading treatment) and 8 (right to respect for private and family life).   They submit that the Moldovan authorities are responsible for the above violations, as they did nothing to prevent them continuing, and that the Russian Federation shares that responsibility as they allege that the territory of Transdniestria is de facto under the control of Russia, which they say has stationed troops and military equipment there and lent support to the separatists.   Procedure   The application was lodged on 14 June 1999. On 20 March 2001 the First Section relinquished jurisdiction in favour of the Grand Chamber under Article 30 of the Convention. On 4 May 2001 the Grand Chamber decided to hold a hearing concerning the admissibility and merits of the application.
