The hospital, knowing the applicant was a Jehovah’s Witness who had reportedly refused any medical treatment, requested permission to safeguard her life and physical integrity from the duty judge. The judge, who did not know the identity of the applicant nor her precise wishes, rendered a decision ordering to save the applicant’s life. Pursuant to this decision a surgery was performed and blood transfusions were administered to the applicant who had not been informed of the duty judge’s order. This decision was upheld on appeal and by the Constitutional Court. The applicant complains under Articles 8 and 9 that while her refusal to certain medical treatments had been clearly established in many official relevant documents, they were ignored by domestic authorities.
