Le demandeur a saisi la Cour européenne des droits de l'homme contre l'Ukraine. Il conteste le refus des juridictions internes d'examiner sa plainte contre une décision du Conseil d'éthique dans le cadre d'un processus de sélection pour un poste au sein du Conseil supérieur de la justice. Il dénonce également l'impossibilité de contester la publication de conclusions du Conseil d'éthique contenant des informations négatives à son égard sur le site internet du Conseil supérieur de la justice. Les griefs portent sur l'accès à un tribunal au titre de l'article 6 § 1 de la Convention européenne des droits de l'homme, ainsi que sur l'ingérence dans sa vie privée et l'absence de recours effectif au titre des articles 8 et 13 de la Convention.
Procédure
La requête a été enregistrée sous le numéro 26911/23 le 21 juin 2023 et communiquée au gouvernement ukrainien le 13 mai 2026. La Cour européenne des droits de l'homme a posé cinq questions aux parties pour éclaircir les aspects juridiques soulevés par le demandeur.

It raises issues of access to court under Article 6 § 1 of the Convention and of interference with the applicant’s private life and lack of remedies in that respect under Articles 8 and 13 of the Convention. QUESTIONS TO THE PARTIES 1.     Was Article   6 §   1 of the Convention under its civil head applicable to the proceedings in the applicant’s case?   2.     If so, did the applicant have access to a court for the determination of his civil rights and obligations, in accordance with Article   6 §   1 of the Convention?   3.     Has there been an interference with the applicant’s right to respect for his private life, within the meaning of Article   8 §   1 of the Convention?   4.     If so, was that interference in accordance with the law and necessary in terms of Article   8 §   2?   5.     Did the applicant have at his disposal an effective domestic remedy for his complaint under Article 8, as required by Article   13 of the Convention?
