Le demandeur a vu son titre de propriété foncière invalidé par l'État, entraînant une privation de propriété sans réparation proportionnée, constituant une violation de l'article 1 du Protocole n°1 à la Convention européenne des droits de l'homme. La Cour européenne des droits de l'homme a condamné l'État pour cette violation. L'État a versé au demandeur une satisfaction équitable correspondant à la valeur du bien dont il a été privé.
Procédure
La décision du Comité des ministres du Conseil de l'Europe, adoptée le 10 décembre 2025, examine l'exécution du jugement final de la Cour européenne des droits de l'homme dans l'affaire Goropashyn contre Ukraine. L'État a informé le Comité des mesures individuelles prises, notamment le paiement de la satisfaction équitable. Le Comité a également examiné la question des mesures générales nécessaires pour prévenir des violations similaires, dans le cadre d'un groupe de cas incluant Maksymenko et Gerasymenko contre Ukraine.

Ukraine group of cases also in the light of the Court’s findings in this case, and that the closure of this case therefore in no way prejudges the Committee’s evaluation of the general measures in relation to the lack of compensation for bona fide purchasers following the removal of their possession ;   DECLARES that it has exercised its functions under Article 46, paragraph 2, of the Convention in this case;   CONCLUDES that the necessary individual measures have been adopted;   DECIDES to continue to supervise the adoption of the necessary general measures in the framework of the Maksymenko and Gerasymenko v.
