  Recalling that the first two cases in this group concern Ms Khadija Ismayilova, an investigative journalist who, as a result of her work, received a threatening letter, had an intimate video secretly filmed in her bedroom and published on the internet, followed by newspaper articles critical of her morality, and that the Court found violations of Articles 8 and 10 of the Convention stemming from the authorities’ failure to protect her rights to respect for her private life and freedom of expression by,   inter alia , failing to carry out an effective criminal investigation into these events; and that the third and fourth cases concern the failure of the authorities to conduct an adequate balancing exercise between the applicants’ right to respect for their private life and the newspaper’s right to freedom of expression;   Recalling that while the intimate videos have been removed, other personal data of Ms Ismayilova appears to remain online and that several shortcomings identified in the European Court’s judgment still have not been investigated by the prosecution authorities;   Recalling that the possibility for Ms Ismayilova to continue her work as a journalist without harassment or hindrance is key, and that this requires further progress with both the individual and the general measures;   REGRETTED   that the Committee’s questions and requests set out in its last decisions on individual and general measures remain unanswered;   REITERATED that,   almost six years after the Court’s judgment in the first case of Khadija Ismayilova , and two years after the reopening of the investigation into the criminal offences committed against the applicant (threatening letter, secret filming and dissemination of intimate videos), progress needs to be urgently achieved to rectify the shortcomings identified in the judgment of the Court, notably by investigating any potential motive arising from the applicant’s journalistic work and to properly question all witnesses and to follow up on all other leads in the reopened proceedings;   UNDERLINED the necessity for the authorities to ensure that Ms Ismayilova can exercise her journalistic activity without any harassment or hindrance;   URGED them more generally to put in place effective measures to protect journalists from attacks, threats and harassment linked to their work, notably by ensuring sufficient Convention-compliant investigations into attacks against journalists;   REITERATED their call on the authorities to elaborate on concrete measures that could be envisaged to bring the implementation of the Media Law fully in line with Council of Europe standards;   STRONGLY INVITED the authorities, in line with the Reykjavik Declaration’s call for strengthening dialogue in the event of difficulties in the implementation of judgments, to hold high level technical contacts with the Secretariat and engage in constructive and results-oriented dialogue with a view to achieving progress in both the individual and general measures required in this group;   INVITED the authorities to submit an updated action plan, including information on all outstanding issues by the end of June 2025, and decided to resume the examination of this group of cases at its 1545 th meeting (December 2025) (DH) at the latest.Citations
