The facts of the case, as submitted by the applicant, may be summarised as follows. On 30 August 2010 the applicant was placed in pre-trial detention in Slobozia Prison. On 18 June 2012 the Bucharest Court of Appeal convicted the applicant for robbery and sentenced him to seven years imprisonment. The applicant served his sentence in Slobozia Prison until September 2014 when he was transferred to Rahova Prison. The applicant submitted that in Slobozia Prison he was held in overcrowding conditions and the drinking water as well as the food was of very poor quality. He further alleged that there was not enough space for the outdoor daily walk and no activities were proposed to prisoners. According to a medical certificate issued by a cardiology doctor and submitted to the applicant’s prison file in November 2013, the applicant was suffering from heart problems and tuberculosis after effects and was recommended to avoid passive smoking. He alleged that, despite the doctor’s recommendations, he was constantly held in cells with smoking prisoners in both Slobozia and Rahova Prisons. Moreover, he alleged that, in both above-mentioned prisons, he was most of the time held in cells together with prisoners suffering from contagious diseases such as hepatitis or AIDS. COMPLAINT The applicant complains in substance under Article 3 of the Convention about the inhuman conditions of his detention in both Slobozia and Rahova Prisons. More specifically, he alleges overcrowding in the cells and the outside walking yard, poor quality of drinking water and food and a lack of activities in Slobozia Prison as well as being held in cells with prisoners who smoke or who suffer from contagious diseases in both prisons, in spite of his doctor’s recommendations and his health condition. QUESTION TO THE PARTIES Has the applicant been subjected to inhuman or degrading treatment, in breach of Article 3 of the Convention, on account of the conditions of his detention in Slobozia and Rahova Prisons?   The Government are invited to submit information concerning the conditions of the applicant’s detention in Slobozia and Rahova Prisons, in particular as regards the overcrowding, poor drinking water and food and lack of activities in Slobozia Prison and his exposure to passive smoking and transmissible diseases in both Slobozia and Rahova Prisons.Citations
