Simultaneously, they declare that they are ready to pay the applicant the sum of PLN 3   000 which they consider to be reasonable in the light of the individual circumstances of the present case, as well as the Court’s case-law in similar cases ( Bojar v.   Poland , application no. 2173/13, decision of 2 July 2015; Nowak v. Poland , application no. 29522/13, decision of 25 June 2015; Przybylski v. Poland , application no. 8951/14, decision of 25 June 2015). The sum referred to above, which is to cover any pecuniary and non-pecuniary damage, as well as costs and expenses, will be free of any taxes that may be applicable. It will be payable within three months from the date of notification of the decision taken by the Court pursuant to Article 37 § 1 of the European Convention of Human Rights. In the event of failure to pay this sum within the said three-month period, the Government undertake to pay simple interest on it, from expiry of that period until settlement, at a rate equal to the marginal lending rate of the European Central Bank during the default periods plus three percentage points. ...” 6.     The Government further requested the Court to strike the application out of its list of cases. 7.     On 8 June 2016, the Court received a letter from the applicant stating that he agreed to the terms of the Government’s declaration. THE LAW 8.     The Court finds that following the applicant’s express agreement to the terms of the declaration made by the Government the case should be treated as a friendly settlement between the parties. 9.     It therefore takes note of the friendly settlement reached between the parties. It is satisfied that the settlement is based on respect for human rights as defined in the Convention and its Protocols and finds no reasons to justify a continued examination of the application. In view of the above, it is appropriate to strike the case out of the list.
