Of the three hearings fixed between 24 February and 21 October 1999, two hearings were adjourned due to the defendant’s failure to appear and one hearing was postponed upon the defendant’

On 28 June 2001 the applicant was summoned to an oral hearing scheduled for 8 September 2001. As he did not appear on that date, the hearing could not be held. 12.

Only a prosecutor was present at the former hearing, whereas the latter hearing was attended by the prosecutor, the applicant and his lawyer.

On 8   December   1994 the court held a hearing and ordered the plaintiff to submit a copy of the statement of claim.

The court did not comment on the applicant’s absence from the hearing before the Court of Appeal. B.

Instead, an audio and video recording of those hearings was played during the trial hearing.

He also could have expected to be notified of any hearing in the case against him by way of summons. 11.

Subsequently, the trial court held hearings on 12   April and 13   September   1995. In 1996 the Regional Court held in total four hearings.

At the hearings, he was permanently escorted by two security officers and seated in an open-roofed secure dock (in the form of a large glass box), which was a permanent fixture in the courtroom.

On 2   April   1996 the court held a hearing. At the hearing held on 23   July   1996 the applicant modified his claim.

The Board also rejected the applicant’s request for an oral hearing as there was no apparent need for such a hearing to be held.

    On 4 April 1997 the Lublin Regional Court held a hearing.

    Further hearings were held on 22 March, 12 April and 17 May 2000. 11.     The hearing listed for 7 June 2000 was adjourned. 12.

The court of appeal shall notify the parties of the date, time and place of its main hearing.
