The applicant had stayed at the scene, as had J.Č. The latter had called her spouse, S.H., who had arrived some minutes later.

On 12 January 2006 the psychologist, Ms   T., had seen all the servicemen including D.N. before they had taken up sentry duties and he had not had any complaints.

The article   explained that M.G. had submitted an application for subsidies, but that his application had disappeared and the complaint for theft he had subsequently lodged had not been followed

The interference had been in accordance with the law and had pursued several legitimate aims: first, the prevention of disorder and crime – as the measure had been designed to determine the true identity

Real evidence had been gathered, sketches had been produced and samples had been taken from the suspects’ hands.

While initially the authorities had had some doubts regarding the parenting skills of the biological parents, eventually both couples had been deemed fit to raise the child.

While the applicant had not disputed that in 2008 she had left for Italy, the Government had not provided any evidence that the authorities had genuinely tried to summon and to find her from 2008 to 2010

He confessed that he had murdered K.K., with whom he had been in a relationship. He stated that he had strangled her as he had been jealous thinking that she had been sleeping with other men.

Also, from the moment that she had retained a lawyer she had responded to all summonses and had insisted on maintaining her complaint. 50 .

Article 3: The applicants had complained about the conditions in which they had been held.

He said that he had had similar problems in the past and had undergone medical treatment in this respect. 7 .

Hence, the crucial question was whether they had been “necessary in a democratic society”, including whether the domestic authorities had had due regard to the applicant’s interests protected by the Article

He had not had a bed or an individual bunk and had been forced to sleep fully clothed on a wooden deck, lying against the other detainees.

Lastly, he alleged that he had had no means of communicating with his son throughout the entire period of his military service.

The court of appeal had analysed the offending text but had not found the applicants’ offers of proof to be pertinent. It had also rejected their defence of good faith.

The standard applied by the domestic authorities had been whether the use of lethal force had been legitimate, as opposed to whether it had been “absolutely necessary” under Article 2 §   2.

However, in the applicant’s case, the bailiffs’ decision had been based solely on the ground that the applicant had not paid the judgment debt voluntarily.

Even where the evidence of an absent witness had not been sole or decisive, the Court had still found a violation of Article 6 §§   1 and 3   (d) when no good reason had been shown for the failure

The eviction order had not yet been enforced.
