    The applicant complained that his inability to comment on the observations filed by the Appellate Public Prosecutor violated his right to a fair trial guaranteed by Article 6 § 1 of the Convention

They maintained, however, that it was for the domestic courts to establish facts and interpret the legislation, and that certain divergencies in the courts’ rulings were acceptable.

The applicant company complained under Article 6 § 1 of the Convention that the proceedings had not been fair and that, as a result, its rights under Article 1 of Protocol No. 1 had also been breached.

In fact, he had obtained compensation after having lodged a claim based on Article 141 et seq. of the Code of Criminal Procedure. The applicant had therefore been provided with sufficient redress.
